The Attorney General of Ohio has significantly revised the proposed State Regulations for nonprofit organizations. The new draft keeps the proposed annual report provision and expands the provision to gather additional information to “determine if a charity is operating in accordance with fiduciary principles.” The new rules also propose creation of a charitable advisory council composed of 9 members appointed by the attorney general. The public still has until August 21st to comment on the proposed rule changes for nonprofit organizations registered in the state of Ohio. Staff, board members, volunteers and those interested in the work of our nonprofit sector are encouraged to make your voice heard.
Several statewide membership organizations, including the Ohio Grantmakers Forum and Ohio Association of Nonprofit Organizations, are preparing formal responses, but comments on the anticipated impact of these rules on large and small nonprofit organizations would be most informative.
